Privacy Policy

Both Commonwealth and New South Wales privacy law (The Privacy Act (1988) and the Health Records and Information Privacy Act (2002) respectively) apply to the Association. These laws are designed to protect your rights with respect to personal information held by private organisations.

The goodwill of clients, donors and customers is important to us. We recognise that we must earn your trust through demonstrating that we have high standards for maintaining your privacy.

Donors and Telemarketing Customers

We collect and store the names, contact details, donation and/or sales history for both donors to the Association and customers of the Huntington's Disease Appeal, our telemarketing operation. We hold this information securely. It is used only to meet our business and legal obligations and to assist us with our fundraising. We may share this information with other organisations we have contracted to assist us with our fundraising, however they must comply with the same privacy laws as the Association.

We conduct our telemarketing and fundraising operations in accordance with a Code of Conduct that incorporates Part C (Fair Conduct Relevant to Telemarketing of the Australian Direct Marketing Association Code of Practice).

We are happy for donors and customers to see the information we hold about them, and to correct any mistakes. To exercise this right you need only write to us, giving your full name and address so that we can identify you. You may also ask us to remove your name from our mailing and calling lists and we will comply with your request. In this case, we will remove all the information that we hold about you unless there are legal or business reasons why we cannot do this. For example, we must by law hold records of tax-deductible donations for 7 years.

Members

We also collect similar information from members of the Association and others who have asked to be placed on our mailing list to receive information from us. We handle this information in the same manner as for donors and customers.

Clients

We collect some information about our clients that is regarded as sensitive as defined in the Privacy Act (1988). Just recording that someone has Huntington's Disease is an example of the collection of sensitive information. Sensitive information may also be health information as defined in the Health Records and Information Privacy Act (2002).

Our collection of this information occurs when:

We collect and hold only the minimum information required to provide services. We hold this information securely, and it is accessible only to staff of the Association who need to know it so as to provide you with a professional client service. If we are seeking your written consent, we will advise you beforehand of:

We will not disclose this health information to other health service providers or anyone else unless you consent, and it is in furtherance of the services you have asked us to provide. However, if you have asked us to provide a service which involves contacting another health services provider on your behalf, we may provide some of your health information to that provider without seeking your written consent. We will only do this where it is clear from the nature of your request that you will expect that we will have to pass on your information.

You may elect to request services from us anonymously and we will do our best to meet your needs. However we may be unable to provide some services in part or full without knowing some personal information. We will also mail information in plain envelopes on request.

Access and Correction of Information

Members and clients have entitlements under the law to see the information that we hold about them, and to request correction of information considered to be incorrect. To exercise this entitlement, you will need to make a request in writing and we may require you to provide evidence of your identity.

Website

We do not collect personal information on this website and do not use cookies or other covert devices. Our website host collects some non-identifying technical information when the website is accessed, such as the type of browser and operating system used, search terms used, domain and referring host. This information cannot be associated with individuals, and is collected to enable us to provide a more useful website.
